The Clerk will so Appointments to the Boa -d of Control for the Establishment of a Northern Virginia Col 1eqe Mr. Urbanske Suppose we accept the resignation and schedule the appointments for the reeting of June 3rd Mr Kaul: 1 would like to comment that at the time the university was put on this site there was an offer of a tract of 500 acres of land for a full four-year college and university and at that time the argument was made that this site was adequate for a two-year school 1 point out at that time that this was far from the educational requirements of Northern Virginia and here we are now after just two years with a request for the local jurisdictions to buy land to extend the univer sity to a four-year university I don t think there is any question about the need and I hope the grants of land will be renewed by the people of Sunset Hills. Mr. Hassan The land has been sold and subdivided for development. Mr. Brown I think what Mr Kaul ssys is correct, but there is one important point that should be made The university, the legislature and the governor indicated that no site would be acceptable on which there was not unanimity of all jurisdictions The City of Alexandr a refused to accept the Sunset Hills tract. World Conference of Local Governments Dinner Mr. Kaul Does the public pay for the dinners of our local people also, or are these funds simply for the visitors? I can see no objection to the use of public funds for our guests. Mr. Urbanske This would cover all of them They estimate about 800 people, of wh'ch maybe 60 to 100 would be local people Mr. Kaul It is not a large amo-^t but I think there is a principle involved here. Mr. Urbanske: This is a report on what we discussed in connection with the budget as to the purchase of the Investment Building. Mr. Lundberg: It is a proced_ral matter and we are moving up the option date from October to July. Mr. Kaul: The only comment 1 would like to make is that this was a procedure for lease with a purchase option which has resulted in a tremendous benefit to the tax payers of the county and j think the conclusion of this is evidence of our having acquired a very valuable piece of property. On. motion by Mr. lirbar.ske, seconded by Mr. Kaul, and unanimously carried, the Board authorized the County Manager to proceed with the acquisition of the Investment Building in accordance with the County’ option said option to be executed on s _!y 1 or as soon thereafter as Is feasible. \(o I Kl \ |V''~| Desegregation of Pa-k. ar.d Recreation Facilities. ’' 1 1 Mr. Urbanske; Mr. Hassan, what is the latest status on operation in Arlington County? Mr. Hassars; The law is stiil on the books and if anybody instigates action under it there will have to be a case. You can't change the statute - that is the legis lature's job - and yew can’ interpret the statute - that is the Court's job. t Mr. Brown; Ws have had two conflicting court decisions in Arlington County. Judge McCarthy has rendered a decision that the law is unconstitutional. Mr. Hassan: Only the Supreme Court of Appeals of Virginia can make it binding. Mr. Brown. Are we to conclude the ruling of Judge McCarthy has no application in Arlington County? Mr. Hassan: You can only assume it is the law until the Supreme Court of Appeals says it isn’ regardless of what Judge McCarthy or any other Judge says. t, Mr. Brown- What are you enforcing and how, and do you feel that on an operational basis Arlington County can live in this murky area? Mr. Lundberg; Certain schools have been desegregated and the children are playing on the playgrounds. We operate a recreation playground program and we should have a policy of the County Board that we can operate it in accordance with the schools. Mr. Brown; Technically, the County is violating the law because nobody has happened to swear out a warrant? Mr. Hassan: When it gets into court the court will decide. All I can say is the law is on the books and if the Judge issues the warrant, there will be a prosecution. Mr. Urbanske: What happens in Fairfax or Alexandria? Have they solved this? Mr. Lundberg In Alexandria the City Council has adopted a policy whereby at such playgrounds located in a school facility where the school has been desegregated, the playground will be operated on the same desegregated basis. Mr. Kaul; Which is the policy you follow Mr. Lundberg: it is the policy the County Board is going to have to determine. Mr. Brown Do you feel you have a clear policy under which you can operate in the present context that there is a law but it Isn’ sure whether it applies? t Mr. Lundberg- The county has no policy. The only policy making body is the County Board. Mr. Brown: ! think first one point ought to be cleared up in behalf of the people who have written this letter to us. This letter, in effect, asks that the County Board take the leadership in desegregating all place of public entertainment, recreation and accommodation in the county, which includes, presumably, the public recreation areas, but also hotels, bowling alleys and theatres. I think it is extremely important to draw a distinction between what the Board can and cannot do. Obviously, private enterprises don't come under the jurisdiction of the Board and we cannot dictate the racial policies to the individuals who own and run these establishments. On county facilities, I think the question is quite different. Of course, I have to yield to Mr. Hassan in the interpretation of the meaning of the law, but it seems to me there are two factors. One, the County is confronted in a recreation policy in dealing with locations and youngsters that have already been desegregated by the School Board and yet, theoretically, under this law, we are supposed to maintain a policy of segregation. Second, it seems to me the status and relevance of the Saw are so murky that in the absence of any guidance, the County Board has a responsibility to establish a policy. I will move that, in �- 13 - o rder to set up cl ear-cut,consistent and fair administrative procedures, the County Board declares it to be the policy of the County to attempt no further enforcement of racial segregation in the use of Arlington’ park and recreational facilities s and that the Manager be instructed to carry out this policy. Obviously, this does not apply to other activities which are under the jurisdiction of the School Board. The motion was seconded by Mr. Richards. Mr. Hassan: Ail I can say is I took an oath of office and as long as that law is on the books, I feel it is my duty to recognize it as the law. Insofar as the policy of the Board is concerned, I want it understood that if anyone gets a warrant from the Judge there will be enforcement regardless of the policy of the Board. Mr Brown: You have had several cases of this k=nd. Have you ever prosecuted under the public assemblage statute? Mr Hassan: I prosecuted under the trespass law and I have prosecuted under the segregation law and on the basis of the facts of the individual case. Mr. Brown: We have had cases where warrants have been sworn out, but has there been a prosecution under the public assemblage law? Mr. Hassan: Yes, but they directed the issue to that of whether the woman was white or colored and the court said there was no evidence that she was white or colored. Mr, Brown: It seems to me in an area that is murky and where our current policies are completely ambiguous and haphazard, we cannot live with this kind of arrangement. I think we must tell the County Manager what our policy is. Mr. Wilt: I would just like to tell you where I stand on it. 1 had an hour's talk with a lifelong friend who is a lawyer and he tells me he doesn't consider this any of our business. Th s is not our function acco d ng to him, and that this is a murky area and it is an area in wh>ch Mr. Hassan and the Courts have to work it out. His advice to me was to stay out of it and I am going to follow h?s advice. Mr. Brown: In the meanwhile, what does Mr. Lundberg do in his recreation program? Mr. Wilt: I suggest Mr. Lundberg talk with Mr. Hassan. Mr Brown- I think our oath of office requires us to declare policies in areas where the absence of a policy makes the situation ludicrous and where the County Manager is being compelled to violate the law. He can honor the law only by following the letter of segregation in all recreation facilities. What does he do at Stratford which is desegregated? When school is over does he blow a whistle and run them all off the playground? Mr. Kaul : If we tell him not to enforce the State law, he could tell us to jump in the lake Mr Urbanske He is asking for guidance. Mr. Kaul: I think it is the policy of the County Manager and County Board to utilize the recreational facilities of the County as widely and fully for the citi zens of the County as possible. It could very well be by a resolution of this type that we can defeat and create a legal situation which would prevent us from carrying out that policy I would like to hear from the Manager and ! would like a recommenda tion from him, Mr, Urbanske; f will support the resolution. The Supreme Court of Appeals can duck the question but we have the problem of dealing with human lives in Arlington County and we must make a judgment as to what is to be done. I think this resolution expresses our sentiment and the desire of Arlington County. We have the problem this year to be solved and I will support the resolution. Mr Kaul What is the policy in Fairfax County? Mr. Lundberg- I don't know. They don't have a policy yet. The only place the policy has come up has been in the school situation. The Supervisors have not been involved because they don’ have a widespread program such as we have. t Mr Kaul Mr Lundberg when did you last attempt to enforce the segregation policy? Mr Lundberg We have been enforcing the seating segregation. We have a seating section with a sign on it and we have attempted to direct the groups into the areas assigned to them Mr Kaul No arrests have beenmade? Mr Lundberg; No It has been an operational enforcement. Mr Brown !f someone calls upand asks permission to play in Barcroft Park and identifies himself as a negro, you say no, but if he doesn't identify himself, you say yes Mr Kaul | am disturbed by an official action of the Arlington County Board to say we hereby direct you not to enforce the State law.I don't know of any precedent f o r this On the other hand. I am anxious that the public facilities be utilized as widely and fully by the public of Arlington County as possible. I just don't ike a resolution that directs the County Manager to attempt no enforcement. I Pr° se a substitute P° 1 wi11 move that it be the policy of Arlington County ^ utilize the public facilities of the county to permit the widest possible public 1 'zation of those public facilities. That would mean the signs could be taken �- ] k - down, the County Manager cou'd advise that the facilities are available and then the enforcement action could be taken by citizens. Mr. Brown: You say my resolution directs the Manager to violate a State law. I completely disagree. May point is that it is not a clear State law and, again, I think the opinion of Judge McCarthy may be cited. Then, the next question is: does the widest possible use of those facilities include the use of those facilities in violation of State law? You are just begging the question. Mr. Kaul: No, ! don't think I am. Mr. Wilt: it would seem, to me that implicit in Mr. Kaul's motion, by the absence of any statment, is that it be done in a legal manner. Mr. Brown: But if his resolution is not to partake in the same illegality as mine, then you can’ have the widest use of public facilities. t Mr. Kaul: The State lew does not say thatAr1ington County mustpost a sign. Mr. Hassan: Yes, it does. (read the statute) Mr. Kaul: ! still feel the right way to solve the problem is by an affirmative policy concerning the utilization of public facilities by all of the citizens of Arlington County. Mr. Urbanske: Under your motion, the widest possible use of these facilities — is that to be interpreted by the Manager that segregation is to exist? Mr. Kaul: It means the County Manager should do everything to use the facilities to the widest use for all of the citizens of Arlington County. Mr. Hassan: Do you mean the County Manager is not to designate the places, or to designate them but not enforce it? Mr. Lundberg: The signs would stay up. My interpretation of Mr. Kaul's motion would be full use of recreational facilities under State law. Mr. Wilt: I will not support Mr. Brown's motion because in my view, Mr. Brown's motion says to Mr. Lundberg, don't enforce this law, and I will not embrace the theory that if you don't like a law you don't have to obey it. Mr. Brown: My position is that it is quite clear by now that there is no clear law. Judge McCarthy specifically stated that in his opinion the law was unconsti tutional . Mr. Hassan: But another Judge in the same court has ruled just the opposite. Mr. Wilt* I will second Mr. Kaul's motion. Mr. Urbanske: I do not consider the motion a true substitute motion but I will let it stand. Mr. Brown: I would like to emphasize that Mr. Lundberg's comment makes it clear the substitute motion does not give him any policy. Mr. Kaul- Mr. Lundberg said the signs would stay up in accordance with the State law. If he says they will stay up in accordance with the State law it is because he believes there is a State law. Therefore, the essence of your motion is that the County Board direct the Manager to violate what the Manager considers a State 1aw. Mr. Brown: Do you consider my motion, if adopted, an order to you to do something j11ega I? Mr. Lundberg: Well, you must go back to the original statement that the law is murky. If the County Board indicates a policy, then I would follow it and work in the murky area of the law. Mr. Brown: Would you carry it out? Mr. Lundberg: Yes, sir. Mr. Brown: And I presume you would not carry out what you consider to be illegal? Mr. Lundberg: No, sir. Mr. Wilt: ! thought you said if Mr. Brown's motion failed you would continue to do these things as listed in the statute. I presume then you presume that to be the la w ? Mr. Lundberg: Right. Mr. Wilt: But if the County Board says it is not the law, then you think they are right ? Mr. Lundberg: Then I would follow the policy of the County Board. Mr. Brown: If you won't take the words "enforcement of racial segregation", you can do it by saying, "instruct the County Manager to see that all public facilities are open to all citizens of the County." If we tell him to open all public facilities to all citizens that is specific. I will move an amendment to the motion that the County Board declares it to be the policy of the county that all public facilities operated by Arlington County are open to all citizens. Mr. Wilt: What do you say, Mr. Hassan? Mr. Hassan: They are open now, subject to the State law. Mr. Brown: Then I withdraw my substitute. Mr. Kaul: I will rephrase my motion. That the public facilities of Arlingtpn County be open to all of the citizens of the county. The motion was seconded by Mr. Wilt. �Mr. Brown: The implication is that the phrase, 1'according to state law" goes on the ta i1 end of it? Mr. Wilt: It is not up to me to pass the law or interpret the law. Mr. Urbanske: Is your intent that this means all facilities are open equally to all the citizens? Mr. Kaul: That all the facilities be open to all the citizens. Mr, Urbanske: How would you administer it, Mr. Lundberg: Would you keep all facili ties equally open to all? Mr. Lundberg: If that is the way you interpret it. Mr. Kaul: I would say that the County Manager can withdraw all the signs that he can do legally. The substitute motion failed by a vote of 2-3, Mr. Brown, Mr. Urbanske and Mr. Richards voting no. Mr. Urbanske: I want to make it clear that there is no restraint in the original motion on any citizen obtaining a warrant. This is strictly as it deals with the public policy. Mr. Brown: And I hope it is completely clear that this policy cannot apply to the athletic, social and other extra-curricular activities administered by the School Board. Original motion carried by a vote of 3-2, Mr. Kaul and Mr. Wilt voting no. Mr. Wilt: I am voting no and I want to make the point that Mr. Hassan says this Board has no authority to pass such a motion. (Mr. Wilt left at this point) Summer Meeting Schedule. On motion by Mr. Kaul, seconded by Mr. Urbanske, and unanimously carried, the Board scheduled its regular meetings for July and August as follows: July 1, July 29, August 5 and August 12. Snow Emergency Plans. Mr. Lundberg: The County Board can act on the plan. Mr. Kaul: Will you have to prepare ordinance changes for penalties? Mr. Hassan: We already have them. The charge is obstructing. Mr. Kaul: This plan has been worked out in conjunction with the regulations of the other jurisdictions and I move it be adopted as the policy of the county. Mr. Richards: I wi11 second the motion. I have some reservations with regard to the initial parking restrictions. I would like to be able to add other streets. Mr. Lundberg: This is not a fixed list. It is a flexible list. Mr. Brown: I think the gentleman who wrote the letter about snow tires is absolutely right. This snow tire business makes no sense to me. Somebody has snow tires with treads worn to zero and yet he is technically complying. Why can't we require chains? Mr. Kaul: It is better than what we have. Mr. Hassan: You could add the word "effective" snow tires and chains. Motion unanimously carried. Proposed Amendment to Ordinance relative to Care of Premises. Mr. Lundberg: This is an attempt on our part to provide local legislation in keeping with State legislation whereby we broaden our enforcement of keeping clean premises. On motion by Mr. Richards, seconded by Mr. Kaul and unanimously carried, the Board authorized advertising for hearing on June 17, 1961, proposed amendments to Chapter 10 of the Arl ington County Code providing the County with authority to require owners of property to remove therefrom all trash, garbage, refuse, litter and other sub stances which might endanger the health of other county residents. Employment of architects for proposed County improvements. Mr. Urbanske: This is a proposal to move ahead in the design of some of our facilities. Mr. Wilt suggested H. D. Nottingham. He said this was the largest employer in the county in this field and they had never been given any work. Mr. Kaul: Isn't it customary to invite two or three different architects in to discuss with them what they would do? Mr. Lundberg: Work that we have involved is small work. In fact, with respect to the libraries, I would recommend we carry on with Russell Bailey. Mr. Brown: I move the Board approve the employment of architects for these projects and the Manager pick the appropriate architects from this list. The motion was seconded by Mr. Richards, Mr. Kaul: What will your process of selection be, Mr. Lundberg? Mr. Lundberg: First I would get the information on what work each one has done. Next, the question is to what extent should we spread the architectural services in the county. Then I would pick the architect for the fire station and one for the recreation department. Mr Kaul: It is your opinion you would give more opportunities for more of them in the county? �16 Mr. Lundberg: I think we should spread it out Mr. Kaul: I wi11 move a substitute motion that the Board make selection of the architects on the basis of the recommendation of the Manager after interview. Mr. Urbanske: Let's make that an amendment. Mr. Richards: I will second the amendment Mr. Lundberg: I wi11 give to the County Board a summary of the qual1ficat ions of the architects. I wi11 not recommend an architect Mr. Kaul- Would you recommend to the Board one or more qualified architects? Mr. Lundberg: Yes, I have no hesitation in doing that, Motion to amend resulted in a tie vote, Hr. Urbanske and Mr. Brown voting no. Original motion carried 3“ Mr. Kaul voting no 1, Annual Audit. Mr. Urbanske: We are apparently quite limited and apparently there is only Murray and Brown, Halquist and the 'lexandria firm Mr. Kaul: Why do we have to moveso quickly on the audit,V/hy can't we wait for the State to give us service such a- thn Fairfax? Mr. Lundberg: The auditors should be appointed prior to July 1 because they frve to be in and close on June 30. We have not been dragging our feet with respect to the State. They have simply told us they are not in a physical position to do it. They don't have the personnel to do i . t Mr Kaul: What would happen if we simply told the State that we want them to audit our books and we will simply wait until they get someone up hereto do it? How about giving that a try. Arlington County pays more into the State revenues than any other jurisdiction in the State and it seems that this is a way of getting some of it back. Mr. Urbanske: I am willing to give it a try. Mr, Kaul. I will move that the Manager be requested to advise the appropriate State officials that Arlington County would like the State to audit our books at the earliest possible date in accordance with ts program, and that they be asked to let us know when they will be here to perform said audit. The motion was seconded by Mr. Richards. Mr. Brown: How much time will you give them? Mr. Lundberg: We will say two weeks. Motion unanimously carried. Placing of Utility Poles in Rights of Way Mr. Richards: I just want to check one thing You will remember several months ago I asked about the county policy of placing utility poles in the middle of newly constructed highways. I notice that in South Walter Reed Drive and in the reconstructed portion of North Quincy Street the same situation obtains, I wonder if we have to acquiesce in this. Cannot we simply refuse to allow them permission and force the poles over to the side? It seems to me when we design and put our money into roads, we have a responsibility to see they are designed to the highest safety conditions, and it is an accepted fact that a pole in the middle of the right of way is r.ot an accepted safety condition, Mr. Lundberg: I will have to check those two situations Mr Richards: Do we have to acquiesce? QUESTION 1: Shall we build an average of one new classroom a week to house the additional children? 20 % (2,253) of the elementary school children are on double shifts. 21% (2,900) of the elementary school children will be on double shifts in 1955-56, if no new schools are built other than those now under construction. Many children are reguired to attend older schools that do not h av e ad e q u a te classrooms, a school library, a multi-purpose room, clinic space, or other m odern conveniences. QUESTION 4: Shall we remodel older school buildings to m ake them m ore n early comparable with our new schools? Good school sites are fast disappearing. Land prices are steadily increasing. QUESTION 5: Shall we buy now the building sites needed in the foreseeable future? 22 of the elementary schools, with 65 % (7,428) of the elem entary school children, do not have a hot lunch program. A hot lunch could be provided these children by equipping the central kitchen in the administration building and by remodeling and equipping these 22 schools.
