STATEMENT OF POLICY ISSUED BY THE ARLINGTON COUNTY
SCHOOL BOARD CONCERNING CURRENT LITIGATION SEEKING INTEGRATION
OF DREW AND HOFFMAN-BOSTON ELEMENTARY SCHOOLS

The School Board has held many lengthy conferences with its attorneys on
the suit instituted by parents in the Drew School area asking the federal
courts to require further integration in the Arlington School System. A
consultant attorney experienced in this field participated in these conferences.
The School Board was eventually advised that the recent Supreme Court
decisions and subsequent decisions by the United States Court of Appeals for the
Fourth Circuit, which includes Virginia, make it clear that the ultimate result
of that case would be a federal court order requiring the Arlington County School
Board to take further steps to integrate its school system into a unitary system.
The School Board has worked with the staff and the attorneys to develop a
plan for integration of the two schools which would best meet not only the
anticipated legal requirements but also the best interests of all Arlington
students and of the community as a whole.
During this process the School Board instructed its attorneys to consult
with the attorneys for the plaintiffs in order to try to reach an agreement
on a desegregation plan that would reduce rather than increase tensions. Several
meetings and conversations took place, but no agreement was reached.
The School Board discussed many times the possibility of inviting the public to take part in the development of a plan. For some weeks, consultation between
our respective attorneys looked like a better procedure; by the time it became
clear that further consultation would be unproductive, there was too little time
for meaningful public participation. For this reason and because of the legal
and technical complexities, the Board decided that the obligation and responsi­
bility could not be so shared, nor would the community benefit by public discussion
of an issue of this nature, especially under these circumstances.
The Board will release tonight the plan it has developed.

Briefly stated:

The students in grades 1-6 of Drew and Hoffman-Boston will be assigned to
elementary schools throughout the Arlington School System. Kindergartens will
continue at both Drew and Hoffman-Boston. No present school boundaries will
be changed. A school will not be assigned students in such numbers that its
total enrollment will exceed its rated capacity by more than 5%. Every elemen­
tary school will be integrated. In future years, students advancing from an
elementary school will attend the junior high school or schools serving that
elementary school and then to the senior high school or schools serving that
junior high school.
During the coming year the School Board will develop plans for a model
school to be located in the Drew building and operated on an integrated basis.
We hope that imaginative new approaches to elementary education and smaller

classes will attract many parents who wish their children to have this
type of education which we cannot now maintain in all schools. Time
does not permit the planning, nor are the funds available, to implement
the model school concept by the beginning of the new school year in
September, 1971. However, the School Board is very willing to explore
this possibility on a reduced scale. It is planned that the Drew School
facility will be used for the Montessori pre-kindergarten, the Drew
kindergarten, adult education, and for other school programs; the HoffmanBoston building will be used for thie Hoffman-Boston pre-kindergarten,
kindergarten, and for the 7th grade of Thomas Jefferson Junior High School.
The details of our plans are being made available to the news media.
Summary sheets will be placed on the table outside the door for interested
individuals. The full details will soon be available at the information
desk in the lobby of this building. They will also be mailed in response
to a phone call to the Information Office— 558-2838.
Speaking for the Board as Chairman, I now move (1) that we instruct
our attorneys to file with the U.S. District Court the plans described in the
staff memorandum and documents of today’s date, and (2) that we instruct the
staff to proceed to carry out the plan.

Guidelines to be Used in Desegregating Drew and Hoffman-Boston
Elementary Schools

1.

Drew and Hoffman-Boston kindergarten students will remain at Drew and
the Thomas Jefferson Annex (where Hoffman-Boston students are presently
housed).

2.

Drew and Hoffman-Boston students for grades 1 through 6 will be assigned
to other elementary schools:
a.

When the added students, would not cause the receiving school to
have an enrollment exceeding its established rated capacity by
more than 5%.

b.

At a ratio of black to white of as close to 11% as is practical
within a range of 7% to 15%, with the exception of the following
elementary schools whose present attendance areas enroll more
than 15% black students:

Fort Myer, whose ratio is approximately 18%

George Mason Center, whose ratio is approximately 19%

SECTION 18-327 OF THE CODE OF VIRGINIA
IS AS FOLLOWS:
"Every person, firm, institution or
corporation operating, maintaining,
keeping, conducting, sponsoring or
permitting any public hall, theatre,
opera house, motion picture show or
any place of public entertainment or
public assemblage which is attended
by both white and colored persons
shall separate the white race and the
colored race and shall set apart and
designate in each such public hall,
theatre, opera house, motion picture
show or place of public entertainment
or public assemblage certain seats
therein to be occupied by white per­
sons and a portion thereof, or certain
seats therein, to be occupied by
colored persons and any such person,
firm, institution or corporation that
shall fail, refuse or neglect to comply
with the provisions of this section
shall be fined not less than one
hundred dollars nor more than five
hundred dollars for each offense."
SECTION 18-328 OF THE CODE OF VIRGINIA
IS AS FOLLOWS:
"Failure to take space assigned in
pursuance of preceding section. Any
person who fails, while in any public

hall, theatre, opera house, motion
picture show or place of public enter­
tainment or public assemblage, to take
and occupy the seat or other space
assigned to them in pursuance of the
provisions of the preceding section by
the manager, usher or other person in
charge of such public hall, theatre,
opera house, motion picture show or
place of public entertainment or public
assemblage or whose duty is to take up
tickets or collect the admission from
the guests therein, or who shall fail
to obey the request of such manager,
usher or other person, as aforesaid,
to change his seat from time to time
as occasion requires, in order that
the preceding section may be complied
with, shall be deemed guilty of a
misdemeanor and upon conviction thereof
shall be fined not less than ten
dollars nor more than twenty-five
dollars for each offense. Further­
more such person may be ejected from
such public hall, theatre, opera house,
motion picture show or place of public
entertainment or public assemblage, or
by a police officer or any other con­
servator of the peace, and if such per­
son ejected shall have paid admission
into such public hall, theatre, opera
house, motion picture show or other
place of public entertainment or public
assemblage, he shall not be entitled to
a return of any part of the same.

The Attorney General of Virginia, in an opinion dated October 16, 1956, states
that "It is, therefore, the duty of the local School Board as a condition pre­
cedent to granting a permit for such meetings, to require that, when such meet­
ings are attended by both white and colored persons, they shall be seated in
spaces or seats designated for members of the respective races. The respon­
sibility for the designation of such spaces or seats is upon the school board
that has the control of the building in which the meeting is to take place. In
the event any such public assemblage is held in a building by permission of
a private owner, the same responsibility rests upon such owner.
Persons who attend such meetings and refuse to take the space assigned for
members of their race would be subject to the enforcement provisions of Title
18 Section 328 of the Code."
In accordance with the above, the Arlington County School Board hereby designates
the front right hand rows of seats (as many as may be required) for members of
the colored race, and the balance of the seats in the auditorium for members of
the white race. Members of the respective races are required to be seated in
the spaces or seats designated for them.

THE COMMITTEE TO STUDY PROBLEMS OF INTEGRATION IN THE
PUBLIC SCHOOLS
■June 23 j 1954*
The Committee on Integration was set up because the Arlington School
Board needs help from many different segments of our Arlington population con
cerning the important matter of putting into effect the recent United States
Supreme Court ruling prohibiting segregation of races in our public schools.
Arlington is a Virginia community where separation of white and Negro
pupils has been practiced ever since public education was first established
in the State, While there are many fine citizens who favor integration, there
are many equally fine citizens who have sincere reservations. With this situa
tion, the best thinking of our community needs to be enlisted so as to study
and make recommendations as to the wisest way to bring about the changes which
will be required during the next few years because of the Supreme Court ruling.
The School Board took into account these principles in setting up
the committee*
1.

The Committee should be large enough to represent
many different areas of thinking among our citizens.

■2.

Persons were not named officially as representatives
of groups.
(For this reason no presidents of organiza
tions were asked to serve on the committee.) Rather,
the individuals named are connected with representative
local organizations and are familiar with the thinking
and policies of such groups. They will not be official
representatives and therefore will not be required to
poll their members in order to suggest or approve a
course of action on any matter coming before the
committee.

Since many diverse aspects of school integration will
probably be studied, the Board named enough people so
the Committee can be sub-divided to study these
different questions. It is expected that other
citizens will be asked by the committee to serve on
sub-committees. Also, the School Board requests that
at least one school staff member be invited to serve
on each sub-committee.

There is great public interest in the work of this body. Because the
committee activities must be so closely tied in with school beard policies,
the School Board asks that all press releases be approved jointly by the
chairman of the Integration Committee and the chairman of the School Board.
The Arlington School Board earnestly needs the help of this Inte
gration Committee. However, it must be made clear that the work of the committee
can be only advisory. The committee will make recommendations to the School

the people may express their wishes and opinions to the
school board.
"Although the school board has the authority and responsibility
in making final decisions, citizen participation in educational
planning is essential at all times."

The Committee on Integration was set up because the Arlington School
Board needs help from many different segments of our Arlington population con
cerning the important matter of putting into effect the recent United States
Supreme Court ruling prohibiting segregation of races in our public schools.
Arlington is a Virginia community where separation of white and Kegro
pupils has been practiced ever sinoe public education was first established
in the State. While there are many fine citizens who favor integration, there
ere many equally fine citizens who have sincere reservations. With this situa
tion, the best thinking of our community needs to be enlisted so as to study
and make recommendations as to the wisest way to bring about the changes which
will be required during the nert few years because of the Supreme Court ruling.
The Sohool Board took into account these principles in setting up
the committee:
1.

The Committee should he large enough to represent
many different areas of thinking among our citizens.

2.

Persons were not named officially es representatives
of groups. (For this reason no presidents of organiza
tions were asked to serve on the committee.) Bather,
the individuals named are connected with representative
local organizations and are familiar with the thinking
and policies of such grouos. They will not he official
representatives and therefore will not be required to
poll their members in order to suggest or approve a
course of action on any matter coning before the
committee.

3 . Since many diverse aspects of school integration will
probably be studied, the Board named enough people so
the Committee can be sub-divided to study these
different questions. It is expected that other
oitizens will be asked by the oommittee to serve on
sub-committees. Also, the School Board requests that
at least one school staff member he Invited to serve
on eaoh subcommittee.

There is great public interest in the work of this body. Because the
Committee activities must he so closely tied in with school hoard policies,
the Sohool Board asks that all press releases he approved jointly by the
chairman of the Integration Committee and the chairman of the School Board.
The Arlington School Board earnestly needs the help of this Inte
gration Committee. However, it must he made clear that the work of the committee
can he only advisory. The committee will make recommendations to the School

Changes to Busing Plan

You have asked for a legal memorandum explaining the
impact of Riddick v. School Board of City of N o r f o l k , 784 F.2d
521 (4th Cir. 1986), on the School Board's ability to consider
changes to the busing plan. You have also asked whether the
School Board is bound by the busing plan approved by the federal
district court in 1971.
The Riddick case indicates that once a
school system has eradicated all vestiges of segregation and is
unitary, it can modify its busing plans without review by the
federal court, absent a showing of an intent to discriminate in
the modification of the plans. Therefore, it is my opinion that
because the federal district court found that Arlington has a
unitary school system the School Board can modify the plan
approved in 1971. Care must be exercised in any modification,
however, as explained below.
Discussion
Both Supreme Court precedent and the Riddick case make
clear that once a school system has eliminated any vestiges of
desegregation and has a unitary system, the school system is not
bound to continue to follow every aspect of an earlier courtordered desegregation plan. S e e , e .g . , Pasadena City Board of
Education v. S p a n g l e r , 427 U.S. 424, 96 S.Ct. 2697 (1976); Swann
v. Charlotte-Mecklenburg Board of E d u c a t i o n , 402 U.S. 1, 91 S.Ct.
1267 (1971). These cases indicate that the School Board is not
responsible for demographic shifts in populations which might
cause schools to slip out of compliance with the original plan,
and accordingly is under no duty to adjust school attendance
figures to reflect those changes to maintain the racial balance
in schools approved in the plan. Once a school system has
achieved unitary status, a court may not order further relief to
counteract resegregation that does not result from the school
system's intentional discriminatory acts. Vaughns v. Board of
E d u c ation of Prince George's C o u n t y , 758 F.2d 983 (4th Cir.
1985).

�The Riddick case gives helpful guidance on other points.
As you know, in that case, the Norfolk School Board abolished
mandatory cross-town busing which had first been required by
court order in 1971.
In its place, all of the elementary schools
became single attendance zones or neighborhood schools. The
attendance zones were structured to achieved maximum racial
integration.
Under the plan, 12 of Norfolk's elementary schools became
70 percent or more black, compared to four under the busing plan
previously in effect.
Of those 12 schools, 10 became 95 percent
or more black. Six schools became 70 percent or more white.
The plan also contains a majority-minority transfer
option, under which any student assigned to attend a school at
which his race constitutes 70 percent or more of the student body
can transfer to a school where his race constitutes less than 50
percent of the students, and receive free transportation.
The trial court considered this plan and found that the
school system no longer operated a dual system. This meant that
the plaintiffs had to show that the school board acted with an
intent to discriminate in adopting the new plan in order for the
action to be found unconstitutional.
The court found that the
plaintiffs had not satisfied the burden of showing this
discriminatory intent.
In reaching that conclusion, the district
court reviewed six factors which the Supreme Court has held must
show freedom from racial discrimination before a school system
can be found unitary:
faculty, staff, transportation practices,
extracurricular activities, facilities and pupil assignment.
Green v. County School B o a r d , 391 U.S. 430, 88 S.Ct. 1689 (1968).
The district court found that the Norfolk school system is
a unitary one. Three of the seven school board members, as well
as the superintendent and two of the three regional assistant
superintendents are black. The faculty is 56 percent white and
44 percent black. The court also found the staff to be fully
integrated. There was no contention that the extracurricular
activities, transportation network or school facilities were
operated in a dual fashion.
In addition, the court found that Norfolk offered
legitimate reasons to support the change in busing. The city was
concerned that the school system continued to lose white students
because of busing, and was concerned about a substantial drop in
parental involvement in the PTAs. The Riddick court found that
while white flight cannot be used as a reason for failure to
dismantle a dual school system, consideration of that factor is
permissible in devising a voluntary plan to improve the racial
balance in the schools.
So too was it legitimate to seek greater

�p a r ental involvement in school affairs, the other reason
proffered for the busing change. Therefore the appellate court
affirmed the district court's decision allowing the change.
Once
the goal of a unitary school system is achieved, said the Riddick
court, the district court's rule ends, and the school system
should be left free to manage itself. The Court also pointed out
that the concept of a neighborhood school system in and of itself
is not violative of the Constitution, citing Crawford v. Los
Angeles Board of E d u c a t i o n , 458 U.S. 527, 102 S.Ct. 3211 (1982);
S w a n n , s u p r a , 402 U.S. at 28, 91 S.Ct. at 1282; Thompson v.
School Board of Newport N e w s , 465 F.2d 83 (4th C i r . 1972) .
The Riddick holding is a limited one. The court by
express terms found it applicable only to those school systems
which have succeeded in eradicating the vestiges of
jure
segregation.
In those systems, the school boards and not the
federal courts "will run the schools, absent a showing of intent
to discriminate." Because the court found the Norfolk School
Board had done a reasonable job in seeking to keep its schools
integrated in the face of a "massive exodus of white students,"
the court stated that it would not refuse to allow the school
board to try another plan that might be successful in stopping
the exodus.
Applying the Riddick principles to our case, the Arlington
County School Board should be permitted to alter the 1971 courtapproved busing plan. The federal district court approved the
plan by its order of August 10, 1971.
In that order, the court
ruled that the school system was "converted to a unitary system
throughout the county." Since Riddick stands for the proposition
that a unitary school system should not be required to adhere to
a prior court-ordered desegregation plan, we can conclude that
the Arlington school system, having been found unitary, need not
follow the terms of the 1971 plan.
I must add several notes of caution in stating this
conclusion, however.
First, in the Riddick case, the court found
important the continuing oversight by the district court of the
Norfolk plan. The d i s t r i ct court had retained jurisdication over
the case, and hence reviewed progress under the busing plan for
four years after the litigation had ended.
In the Arlington
case, however, the judge reviewed the plan after it had been
followed for approximately three months and found at that point
that Arlington had established a unitary system. Therefore, one
major difference b e tween Arlington's situation and Norfolk's is
that in finding Norfolk's system was unitary the Norfolk court
was able to evaluate more thoroughly the school system's
adherence to and p r o gress under the busing plan, because the
court had followed the case for four years.

�Second, the Riddick court found the Norfolk school system
was unitary after reviewing the six factors identified by the
Green case. I lack sufficient information to know what the
result would be if those six factors were examined in Arlington,
but can examine them if provided the necessary information.
In
the alternative, of course, someone from your staff can apply
these factors to the pertinent data.
These differences between the Norfolk and the Arlington
cases should not m e a n that Arlington cannot deviate from the 1971
busing plan. I point out these differences, however, so you are
aware that these differences could be identified in an effort to
distinguish the two cases and thus contend that the Riddick case
does not permit the Arlington County School Board to deviate from
the busing plan.
Finally, you should also be aware that the Supreme Court
declined to review the Riddick case, 55 U.S.L.W. 3311 (U.S.
Nov. 4, 1986), and the Riddick opinion therefore is binding
precedent in this judicial circuit. At the same time the Court
denied review in R i d d i c k , however, it also denied review in a
case from the Tenth C i r c u it in which the appellate court reached
conclusions contrary to those stated in R i d d i c k . Therefore, we
cannot assume the S u p r e m e Court has endorsed the Riddick opinion
by refusing to review it, or that the Supreme Court would come
out the same way when a similar issue is before it. The Riddick
opinion does stand as good authority in this judicial circuit,
however, and supports the conclusion that Arlington can make
changes to its busing plan.

Dear Mrs. Whipple:
At its regularly scheduled Delegate Assembly on March 12, the
Arlington Education Association adopted the attached resolution expressing
"no confidence" in Superintendent Larry Cuban and urging his resignation.
The staff of the schools has witnessed the third year of recommenda­
tions from Dr. Cuban for salary adjustments well below increases in the
Consumer Price Index. The impact on the employees I represent is a 12
percent drop in the value of the salaries received in just three years'
time.
In spite of well articulated advice through proper channels
supported with data and rationale, the Superintendent has stubbornly
refused to alter the pattern of his advice.
The School Board was able to adopt a budget below that recommended by
the Superintendent which included a larger pay adjustment, program improve­
ments and additional capital improvements without eliminating or reducing
any current service. The resources were available when Dr. Cuban prepared
his budget, and others came to light during the budgeting process. Still
the Superintendent would take no initiative to protect the employees of
the schools from a sharply diminished living standard. The salary schedule
is now worth less real buying power than in 1967 and has lost $900 per step
in just five years.
Teachers now believe this will be Dr. Cuban's pattern as long as he
remains here. We can stand no more.
The draft of the attached resolution was discussed at our meeting in
February. Delegates were urged to discuss the matter with the staffs they
represent and come prepared to vote the consensus they received. After a
full discussion and several amendments, the resolution was overwhelmingly
passed.
We urge the School Board to consider whether the good of the Arlington
Schools will be served by Dr. Cuban's continued employment.

RESOLUTION OF DELEGATE ASSEMBLY ADOPTED ON MARCH 12, 1979:

WHEREAS, Superintendent of Schools Larry Cuban has consistently exhibited
a callous and cavalier attitude toward employees by presenting a
series of budgets which have consistently lowered the standard of
living of Arlington school employees, and
WHEREAS, his reluctance to seek adequate financial support for the
schools has resulted in a decline in morale which, if unchecked,
will cause the deterioration of the Arlington schools, and
WHEREAS, the Delegate Assembly of the Arlington Education Association
feels that an "adequate budget" with a less than adequate salary
improvement is a contradiction in terms,
BE IT RESOLVED that the Delegate Assembly of the AEA has lost confidence
in Dr. Cuban’s leadership of our school system and urges his
resignation.

BLOOD BANK NOTICE - IMPORTANT: A number of Building Directors have asked
about a deadline on returning the pink forms for membership in the Metro
politan Uashington Blood Bank plan. Please be sure that every AEA member
has the opportunity to know of this benefit of group membership. A special
arrangement is being made available ior those AEA members who wish to
participate. Only those AEA members who pledge are immediately a part of
the group. Other AEA members who do not wish to participate by pledging
are not then counted against our quota and are not elegible to receive
blood through this plan.
Please be clear on this point with members so
that we do not have misunderstandings at a later date. An article on page
2 of the October issue of the AEA REFORTER (now at the printers) will ex
plain this again to members.
The deadline for this initial drive is the next Board of Directors
meeting, October 22, Kenmore at 7:00 P.M. Please bring the pledge forms
and any questions your members have about the plan. Members may be en
rolled all during the year, but are not covered until the pledge form is
in the AEA office for processing and sending on to the MLl
IBB.
Important - any member who is unable to give blood for any reason should
secure a substitute pledge.
It is possible for many individuals to donate
blood several times a year.
If no substitute can be secured, let us know in
the AEA office. I e will try to find a substitute for a member who is unable
d
to give blood for medical reasons.
FINANCIAL REPORT: Please take note of the recommendation to erase the
deficit of 3372 incurred for AEA insurance and bonding taken on a three year
basis. This will save the association 373, as noted in the enclosed memo,
on bonding and insurance (AEA //60).
Other deficits incurred by committees were discussed.
They arose in
view of increased activity and expanded programs beyond budget anticipation
in April when the budget was prepared.
The president has called for an
analysis of all committee projects and financial needs for the rest of the
year. The officers have asked the executive secretary to come up with some
written proposals to consider a policy in handling AEA fiscal matters.
These policies will be reviewed at the next meeting of the Executive Com
mittee.
AEA QUESTIONNAIRE - The enclosed memo (AEA #50) on the tabulation of last
Spring's questionnaire should be considered for discussion on October 22.
After your acceptance of the report, consideration should be tjiven by of
ficers and committee chairmen of using these results for building future
AEA programs.
NEA EVALUATION: At Harpers Ferry and in packets distributed to those who
were unable to attend, copies of the NEA Evaluation of AEA were given to
you. Please inform your members that the report is available for their
study. A limited number of additional copies can be ordered for use in
faculty roams. A number will be kept on file in the AEA office. Committee
Chairmen will appreciate member's reaction to features of the report that
will help in formulation of proposals to implement any desirable recommenda
tions .

LEGISLATION: Please review the enclosed proposals for supplementing the
state association legislative programs.
They were recommended to you by
the Executive Committee.
You will be asked to vote on them on October 22
in preparation for state conventions - October 20-30.
Also take note of the special committee set up to deal with the VEA
study of the question of membership in VEA as affected by the NEA Resolu
tion on Desegregation of State and Local Affiliates adopted at last July's
convention in Seattle.
The special committee, appointed by the president
(see executive minutes, P. 1), met on October 15 to consider an AEA position
on this question.
If possible we will try to get you the results of their
deliberation prior to your October 22 meeting.
CITIZENSHIP: Rose Holton, Citizenship Committee Chairman, has agreed to co
ordinate the VEA initiated project of calling in election returns from local
precincts throughout the state.
The VEA's Executive Committee and Board of Directors announced their
acceptance of the project and told us that they decided that the 1,5000 com
pensation for all the local poll workers for calling in the results to our
local news media would be put into the VEA President's Scholarship Fund.
In discussing this at the District H Board meeting with Mrs. Halliday,
District H President, and officers from Alexandria and Falls Church, it was
decided that we would agree to participate with the stipulation that a pro
rata share of the .|&gt;5000 could be returned t D those locals who requested it
for their own Scholarship funds.
This request apparently upset the VEA executive secretary. We have
the additional problem in Arlington of having a Citizenship Chairman (our
logical official to coordinate such a project) who is not now eligible for
VEA membership.
L e are going ahead with the project, which is an excellent opportunity
i
for us to cooperate with our news media services.
They will count on us to
do a top job for them in getting quick election returns for their readers
and viewers. We have the understanding that we will receive a prorata share
of the !.,500D for the Arlington County Teachers Scholarship Fund, Inc., a
non-profit corporation which helps Arlington students and teachers with
scholarship assistance through fund raising of its own. AEA contributes
s
v5Q0 from its budget each year and has a representative on the Fund's Board
of Directors.

PERSONNEL POLICIES: Your teachers should recognize that the Arlington
Education Association has been named by school board policy as an official
organization to participate in the review of all personnel policies now
being compiled in the school board's new administrative manual. As a part
of the official procedure, before any action is taken on changes, our Com­
mittee will submit recommendations for suggested improvements and have an
opportunity to discuss them with the superintendent.
This is a big step
forward for AEA and should be so recognized by your members as well as nonmembers . This is one phase of the official recognition we discussed with
the school board last year.
Please inform your faculties of this progress.
N A i INSURANCE: Information on the expanded group life insurance plan of

NEA was explained in the October issue of the NEA JOURNAL. Brochures and
posters on this excellent group coverage are being ordered to give NEA mem­
bers maximum information on the improved benefits to those who are members of
both the NEA and a state affiliate.
AEA'5 WASHINGTON NATIONAL INCuME PROTECTION - we are working with Washington
National officials to prepare material for all new AEA members who are new
to the school system. There are no insurability questions for this group.
Members who were in the system last year, but missed the "open period" in
February, can still take out the insurance provided they can establish their
insurability.

12. DESEGREGATION IN THE PUBLIC SCHOOLS*

In light of these principles,*the Representative Assembly instructs
the officers and directors of the National Education Association—
a.

To direct all local, district, and state associations
affiliated with the National Education Association to
take immediate steps to remove all restrictive member­
ship requirements dealing with race, creed, or ethnic
groups.

b.

To take immediate action to develop plans to effect
the complete integration of all local and state af­
filiates whose memberships are now limited to educa­
tors of specifically designated racial, religious,
or ethnic groups.

Affiliates whose memberships reflect the above-mentioned restrictions
shall be given until July 1, 1966, to revise their constitutions and bylaws,
where necessary, to take whatever steps are required to expedite the com­
plete removal of all restrictive labels, and to present a plan to effect
the complete integration of their associations.
Should an affiliated association fail to comply with these requirements
by July 1, 1966, the Executive Committee shall have the discretionary powers
to take necessary action.

1.

i/ualif ications for membership in education associations should
be based on education, not on race.

2.

There should be one state education association open to all
qualified teachers.

3.

Any qualified teacher should be able to apply for and receive
membership in a local association.

A teacher member of a local association should be oble to apply
for and receive membership in the state education association if
he is qualified to dD so.

5.

Any qualified teacher for whom there is no local association should
be able to apply for and receive membership in the state education
association.

6.

The constitution of the state education association should be the
factor which decides membership, and there should be no abridgement
by local education associations or the state education association.

7.

The merger of the Virginia Teachers association and the Virginia
Education Association should be an orderly procedure accomplished
by a committee representing both organizations and composed of
members from both organizations.

8.

In the merger of the two organizations the interests of the em­
ployees of both associations should be cared for as well as the
interests of the two organizations.

9.

The constitution of the Virginia Education association should be
amended where necessary to accomplish the merger of the Virginia
Teachers Association with the Virginia Education Association.

We move that the UEA Staff and officers take ths leadership in forming and
convening a VEA-VTA joint, fact-finding committee and further that the charge
to this joint committee be:
(1)

To study the full implications of WEA Resolution „12, titled
Deseqretion in the Fublic Schools, adopted at the 196L convention'.'

(2)

To conduct a survey of local affiliates of UEA and VTA to determine:
a) The number of members of each of the l/irginia state as­
sociations currently in desegregated or merged locals.
b) The percent of total membership in each state associa­
tion represented by those currently in desegregated
or merged locals.
c) The way desegregation or merger uas accomplished in
each of these locals,
... the difficulties that were encountered,
... the means used to overcome the difficulties, and
... the feeling of members regarding advantages or
disadvantages of the desegregation or merger.
d) The current discussions, studies or plans for desegregation
or merger taking place in segregated locals in Virginia.
e) The status of desegregation in each of the public school
systems in l/irginia.

(3)

To survey (or request WEA to survey) other state associations that
have recently effected desegregation or merger of their state and
local associations as well as those still maintaining segregated
associations. This should be done with reference to the current
status and thinking of others affected by the WEA Resolution.

(L)

To determine what major obstacles and requirements would be en­
countered in merging the state and local associations in Uirginia.

(5)

To determine what might be the ultimate consequences of an effort
to maintain segregated state associations in view of WEA Resolu­
tion i'i 12.

(6)

To project a timetable for a proposal to merge Virginia's state
and local associations based on the estimated timE required to
overcome the major obstacles and tD implement requirements for
merger.

(7)

To publish a full report on the findings of this joint committee
in the May issue of the respective state journals.

The existing policy for the implementation of the salary schedule in Arlington
County states that a career teacher earning a Masters' degree is to receive a sal­
ary increase not to exceed $500. Under the present policy, a teacher transferring
from the Bachelor's Career Scale to the Masters' Career Scale may receive an in­
crease of $100, $200, $300, $AD0 or $500 solely dependent upon the particular salary
step he has attained on the BA Career Scale when his degree work is completed. The
actual differentials for this transfer under existing policies are indicated graph­
ically by the arrows in Appendix I on page 3.
In the 1962-63 Salary Scale, all teachers who transferred from the BA Scale to
the MA 5cale received a $A00 differential at each step. The present transfer policy
for moving a teacher from the MA Career Scale to the Doctor's Career Scale similarly
provides a regular $500 differential at all steps of the MA Scale. The BA Career
Scale does not provide for the same increments at corresponding steps on the MA
5cale; therefore, the transfer differential presents the varying pattern mentioned
above.
The inequity involved in the present transfer procedures may be better under­
stood if one considers two hypothetical teachers; A and B as designated on the
Scales in Appendix I. Teacher A is on Step 11, teacher B is on Step 12 of the
Bachelor Career Scale. Teacher A with a salary of $8A00 on the BA Career Scale can
transfer to the MA Career 5cale Step 10 with a salary of $8900 giving a differential
of $500. Teacher B with an $8800 salary and one step ahead of teacher A on the BA
Career Scale cannot move to Step 11 with a $9A00 salary on the MA Career Scale be­
cause the differential would be $600 or $100 in excess of the present $500 limita­
tion on such transfers. By existing policy teacher B is also placed on Step 10 of
the MA Career Scale with only a $100 differential for having acquired his MA degree.
Teacher B has received $A00 less than teacher A for his MA Oegree; yet both teachers
have met identical requirements. Therefore, the only difference between the two
teachers is the fortuitous circumstance of which step of the BA Career Scale they
are on at the time they receive the MA Degree.
One teacher who actually received the $100 increase in the above example,
estimated that despite the fact he received some scholarship assistance, he had
spent in excess of $1,000 for tuition and books at the American University in order
to obtain his MA degree. In addition, he estimated that he invested over 1,500
hours of his time in preparing for his advanced degree. This latter figure was
calculated by estimating that it took two hours of preparation for each hour in
class. If this teacher had spent a like amount of time on a part-time job that paid
a minimal wage of $2.00 per hour, he could have earned $3,000. This means that for
a personal investment equivalent to $A,000 he received an immediate monetary return
of only $100 on the salary schedule.
Extensive thought and study has been given to this problem by our school admin­
istration and teachers alike. Although the Bachelor's Career Scale and the Masters'
Career Scale begin with a differential of $500, they progress with unequal incre­
ments as pointed out above; the existing problem in one form or another is unavoid­
ably with us. That is, it does not appear possible to arrange the two salary scales
so that teachers can transfer from varying steps on the BA Career Scale to the MA
Career Scale with a comparable differential without a significant revision of the
existing salary scale which would affect many teachers who have no relationship to
the transfer problem. The only approach that appeared feasible in attempting to
correct the inequities in the existing policy will place some teachers between steps
of the MA Career Scale for varying periods of time. Understandably the administra­
tion of salaries and accurate appraisal of continuing costs of the salary scales
would be more complex if large numbers of teachers received salaries placing them
between steps on the salary scale.

However, the paint af greatest importance to staff morale is that teachers
should receive equal differentials in salary as the result of having attained com­
parable advanced degrees. The 5alary Committee made every effort to eliminate the
salary inequity-while maintaining the maximum degree of administrative efficiency
in-fiscal management. A solution has been proposed by the AEA Salary Committee
which- would remove the transfer inequity by granting all BA Career teachers the same
differential while leaving them between steps the shortest period of time. Specif­
ically, the proposal is: That the Arlington County School Board authorize, in addi­
tion to the yearly increment, an increase in salary of $500 for the current year for
any BA Career Scale teacher who has shown evidence of having completed his Plasters'
degree requirements before September 1, 196A, and that such teacher shall receive a
minimum increment of SABO in each succeeding year until he reaches an established
step on the PIA Career Scale, such step to be reached by $500 increment wherever
applicable. It is further recommended that the stipulations herein shall also apply
to BA Career Scale teachers who complete Plasters' degree requirements subsequent to
September 1, 196A as well as those who qualified for the P A Career Scale effective
I
September 1, 1963.
As described graphically in Appendix II, page A, this proposal would equalize
the salary differential for the P A and put teachers at particular places in between
I
steps for a minimal period of time. The proposed career transfer scale attempts to
retain simplicity in arrangement so that it can be easily interpreted; in annual
cost appraisals, the relatively few teachers between steps in a given year would be
nominal.
An analysis of the plan will show that of the 11 possible transfer steps, three
BA steps (6A0Q, 8A00 and 1D5B0) move teachers to the PIA Career Scale directly; five
BA steps (8000, 880B, 92BB, 9600 and 10000). will require only one year between PIA
steps; and three BA steps will be out of a phase for 2 years (7600), 3 years (7200)
and A years (6800), respectively (see Appendix II for graphic description). Since
only 15-20 teachers are expected to move from the BA Career Scale to the PIA Career
Scale annually, the $5Q0 differential for all would not likely require a great deal
more money than the cost for the existing policy which provides $100, $200, $300,
$A00 or $500.
It is our sincere hope that such a plan can be developed in the best interest
of teacher morale. Ue pledge our full support in the effort to achieve an equitable
solution to this vexing problem.
