YOUR INTRODUCTION TO COORDINATION.
Our modern world was built through the principles of coordination.

We can

use the same principles to build up the Negro voting strength.
I.

COORDINATION:

We believe that by coordinating the suffrage work of vari­

ous organizations and individuals, the Negro will have a more effective
Political Action Program.

This in turn will produce a large and intelli­

gent Negro vote.
II.

WHY SHOULD WE COORDINATE OUR EFFORTS?

We should coordinate our efforts

because in spite of the fine suffrage work being done by many groups
and individuals in the South, we are faced with the following facts:
1.

Only about 20% of the potential Negro voting population are re­
gistered voters.

2.

That large numbers of Negroes qualified to vote do not show up at
the polls on election day.

3.

That large numbers of Negroes pay their poll taxes in states where
it is required, but fail to register.

That most areas lack organizational machinery to contact the masses
of people for the purpose of giving out factual and unbiased infor­
mation on political candidates and issues.

III.

IS THIS A POLITICAL GROUP?
are non-partisan.

IV.

NO!

Our coordinating groups or organizations

Their only aim is a large intelligent Negro vote.

WHY NON-PARTISAN?
1.

Because

the N A A C P

is n o n - p a r t i s a n .

2.

Because for this plan to be successful, we must have the cooperation
of all groups and organizations regardless of their political beliefs.

3.

History has shown that many non-partisan organizations for increasing
the vote folded up because they became ambitious and began playing
politics, or individuals in the organization began using the organi­
zation for personal gains.

V.

WHAT CAN YOU DO?

You can start a coordinating group in your area.

How­

ever, you must first sell yourself on the coordinating group idea.

Changes in junior high school attendance areas

As a part of its responsibilities under the State Laws pertaining to the Local Assignment of Pupils, the
A r l i n g t o n County School Board must fix attendance areas for the assignment of students.
In order to carry
out this responsibility, the School Board and staff have carefully studied the existing attendance areas,
the effect on these areas of the projected enrollments for the next five years and the possible effects of
major highway construction and other relevant factors.
In providing the best instructional setting with
out severe overcrowding at certain schools, and in taking into account the additional facts, these changes
are b e i n g proposed.
Effective w i t h the start of the next school y e a r , September 1 9 6 1 , all students who are presently in the 6t h ,

Notice to parents re:

Changes in all senior high school attendance areas

As a part of its responsibilities under the State Laws pertaining to the Local Assignment of Pupils, the
Ar l i n g t o n County School Board must fix attendance areas for the assignment of students.
In order to carry
out this responsibility, the School Board and staff have carefully studied the existing attendance areas,
the effect on these areas of the projected enrollments for the next five years and the possible effeots of
m a j o r hig h w a y construction and other relevant faotors.
In providing the best instructional setting with­
out severe overcrowding at certain schools, and in taking into account the additional facts, the changes
listed b e l o w are being proposed.
In m a k i n g these changes the following administrative procedures will be used:
(l) present llth-grade
students will be permitted to remain in the high school they are now attending for the 1 2 t h grade next
year; (2) all present 9th- and lOth-grade students will be assigned to a high sohool on the basis of new
attendance areas.
The School Board will hold a Special Public Hearing on these changes in sohool attendanoe areas on M aroh
14, 1961 at 8 p.m. in the Little Theatre, Washington-Lee High School, 1300 North Quincy Street, Arlington.

B a r b a r a M arx

Since 1949, Mrs. Barbara Marx, Supervisor of the 7th District of NAACP
Branches.has played a vital part in affairs for racial uplift in north­
ern Virginia.
She has been Supervisor of the 7th District for about seven
years and has never missed preparing for or missed a meeting.
Mrs. Marx has taken a leading part in the de-segregation of schools in
Arlington County, working with colored parents and children and enlisting
the support of many white people toward this end. Bhe has been chairman
of the Executive Committee of the Arlington Branch for many years and has
served as member of the State Board of Directors for more than six years.
For several years Mrs. Marx was chairman of the Political Action Commit­
tee of the State Conference.
Her work in Front Royal has been outstanding in helping the people
there, not only in NAACP programs but in personal relations. She was ac­
tive in the work of the Washington "Front Royal Education Fund'r which
raised over £10,000. to keep the Front Royal children in school when the
high school at front RoyaJ was closed to prevent de-segregation, and to
continue them in school after the high school was de-segregateu.
In Arlington, Mrs. Marx has been the instigator of several legal
attempts to defeat the Public Assembly Law. There has been no instance of
a court case in Arlington or Alexandria when M r s . Marx has failed to be
present. Because of her interest many white people have become affiliated
with the N a ACP.
Because of the publicity attending her work, she and her family
have been subjected to vicious abuse by the bigots. They have committed
depredations on her property and used obscene language of the vilest
sort over the telephone to her and her daughters.
For reason of her devoted efforts in our behalf, some of the
officero and members of the Branches in northern Virginia have planned
to show her our appreciation for the work she is still doing. The Anti^efaraation "eague of B ’nai Brith has honored her on at least two occasions
in New York State ana Pennsylvahia for her contributions to freedoraalthough Mrs. Marx is not a Jew. Let it not be said,That a prophet is
not without honor save in his own community."
To implement this purpose a committee has come together to plan
for a testimonial to Mrs. Marx on the occasion of the June Meeting of the
seventh district. To do something tangible, it is planned to secure
subscriptions from our members and her friends and present her with a
NAACP LIFE MEMBERSHIP. The following committee has assumed this task:

For many years the bar of Virginia has been concerned with unlawful

and improper practices connected with the administration of justice.

The

creation of the Virginia State Bar in 1938 alleviated the situation tempo
rarily, but in the post-war years the problem has become more aggravated.
The General Assembly of 1956 in special session created two oommitteea
to investigate and report upon these matters, both of which reported to the
Session of 1958.

The General Assembly then directed an entirely new study

by enacting Chapter 373 of the Acts of Assembly of 1958 (Code s@ 30-1(2
through 30-51).
The directive imposed upon the Committee so created is as follows8
"(a) There is hereby.created a joint committee of the General
Assembly to be known as the Committee on Offenses Against the Ad
ministration of Justice, hereinafter sometimes referred to as Joint
Committee. Such Joint Committee shall investigate and determine
the extent and manner in which the laws of the Commonwealth relating
to the administration of justice are being observed, administered and
enforced and shall specifically direct its attention to the observance
and to the methods and means of administration and enforcement of
those laws, whether statutory or common law, relating to champerty,
maintenance, barratry, running and capping and other offenses of any
other nature relating to the promotion or support of litigation by
persons who are not parties thereto.

�"(b) The Joint Committee is further authorized to investigate
and determine the extent and manner in which the laws of the Common
wealth relating to State income and other taxes are being observed
by, and administered and enforced with respect to, persons, corpora
tions, organizations, associations and other individuals and groups
who or which seek to promote or support litigation to which they are
not parties contrary to the statutes and common law pertaining to
champerty, maintenance, barratry, running and capping and other of
fenses of like nature."

The Committee organized and elected Ms. Boatwright Chairman and Sena
tor Fitzpatrick Vice-Chairman.

The staff consisted of John B. Boatwright,

Jr., Secretary-Clerk, and F. W. Harkrader, Jr., Recording Secretary.
W i l i a m H. King, of the Richmond City Bar was retained as counsel.
The Committee met with leaders of the Virginia State Bar, Chairmen
of committees thereof, and others with a view to obtaining information to
assist it in its study.

Investigators were employed to gather evidence

concerning the activities of various groups and individuals which appeared
to merit investigation.

Data was obtained from a number of State officials

for use in the work of the Committee.

Numerous hearings were held to examine

witnesses and receive documentary evidence.
Although the Committee examined the activities of numerous groups
of varying types, it was only the National Association for the Advancement
of Colored People and its affiliates that sought by court proceedings to
deter the functioning of the Committee.

A listing of the many court ap

pearances is made in the 'Appendix" filed with this report.

�We set forth our* findings, conclusions and recommendations under sever
al different headings.
1.

litigation In the Federal Courts.

Immediately upon the formation of the Committee, the National Asso
ciation for the Advancement of Colored People (hereinafter referred to as
"NAACP") and the Virginia State Conference of NAACP Branches (hereinafter
referred to as “Conference") instituted a proceeding in the Federal Dis
trict Court in Richmond to enjoin the Committee from investigating their
activities, and seeking especially to restrain enforcement of an attachment
provision (3 30-1*7) contained in the Act creating the Committee.

The court

■which heard the case was composed of Judges Soper, Hoffman and Bryan.
After hearing argument, the Court entered an order to the following effects
“This cause came on for hearing upon the defendants' motion to
dismiss and their answer to the plaintiff's complaint, and it was
shown to the court that interrogatories propounded by the defendants
were issued out of the Circuit Court of the City of Richmond on Sep
tember 8, 1958, and thereafter served upon the plaintiffs that there
after on September 17, 1958, the defendants and plaintiff agreed that
a portion of the interrogatories designated by certain markings, a
copy of the interrogatories with such markings having been filed in the
record in this cause, need not be answered by the plaintiffs until a
final determination of the issues raised herein; this cause was there
upon argued by counsel.
"Upon these facts, and upon assurances given by counsel for the
defendants that any attachment of papers or other properties in the
possession or subject to the control of the plaintiff, made pursuant
to Section 6 of Chapter 373 of the Acts of Assembly of Virginia of
1958, shall not be made public or be subject to examination, except by
the plaintiff's counsel, until the plaintiff, if moving to quash such
attachment, shall have exhausted all right of appeal from a denial of
such motion, and the court being of the opinion that similar protect
ion should he given to the papers or other properties in the posses
sion or subject to the control of the affilitates of the plaintiff,
and being also of the opinion that pending the final determination of
any motion to quash any such attachment, the attached papers or pro
perties should be available for reference by the owners thereof in
the regular course of their business, it is

'ORDERED that upon any such attachment the attached papers or
properties of the plaintiff or its affiliates shall be at once
sealed and delivered to Oliver W. Hill, Esquire, plaintiff’s attorney
and as such also an officer of this court, to be held by him pending

ment, and that he may allow the owners of the said attached papers or
properties access to them but only for such reference as may be neces
sary in the regular course of business of the owners, the said attorney
to be answerable to this court for the protection of the said papers or

upon the questions involved in this cause by the trial court of the
State, the highest court of the State and ultimately, if desired, by
the Supreme Court of the United States, it is further

Thereafter the General Assembly amended 8 30-1)7 to expressly require
that papers attached remain sealed and -under the control of the Court until
a motion to quash, if filed, has been ruled upon, and to further provide
that the owner of the papers may for good cause examine them while attached.
Re commendation s

That proceedings be commenced to modify this order of

the Federal Court.
Reasons

Oliver W. Hill is chairman of the legal staff cf the Conference,

which staff consists of approximately 15 lawyers practicing in this Common
wealth.

Witnesses before committees of the General Assembly and in Federal

Court have testified that Hill, and associates often have taken legal steps,
purportedly acting as lawyers for the witnesses, bat without their know
ledge or consent.

This conduct is clearly reprehensible, serving to promote

litigation in the names of ostensible, but not real, parties.

Although the

Committee considers further evidence of such conduct necessary, yet the order
of the Federal Court imposes an intolerable burden for, if evidence of the
apparent misconduct of Mr. Hill and his associates is shown by papers which
may be attached, under such order Mr. Hill would have sole access to those
papers and thus enjoy an opportunity to deprive the Committee of evidence

�it has the right to obtain through its powers of investigation.
Further, should such restrictive holding be permitted to stand, it could
well serve as a precedent to be later followed in crippling the powers of in
vestigation of all legislative committees, both State and Federal.
2.

Solicitation of Business by Lawyers.

Persons employed by the Committee investigated a number of complaints
which reached us concerning the solicitation of business b y lawyers.
of these were in the field of personal injury cases.

Most

Evidence of such mal

practice is difficult to obtain as witnesses are customarily hushed-up on
the lawyer learning that his activities are under scrutiny.

Also, it appears

that some members of the bar, although knowing of instances of wrongdoing
by their fellow lawyers, fail to report such wrongdoing to disciplinary
authority because of an unwillingness to assume responsibility for the
resulting punishment.

Despite this, incriminating evidence of malpractice

has been gathered by the Committee and turned over to the appropriate dis
ciplinary committees of the Virginia State Bar.
Recommendations

Virginia State Bar should stress to its members their

duty or reporting each instance of unprofessional conduct.
Reasons

Not only does unprofessional conduct by a lawyer reflect upon

the bar generally, but often results in great harm to the client.

It is only

by the cooperation of lawyers that such harm can be lessened.
3.

Collection Agencies»

A statute of Virginia prohibits the use of papers simulating court doc
uments in the collection of debts.

Such documents, particularly when used

b y a lay agency, are not only patently deceitful, but border on the user's
engaging in the unauthorized practise of law.

The Committee has found cases

in which collection agencies have used papers in clear violation of the sta
tute.

We have been impressed by the burden incased upon the ten district
committees of the Virginia State Bar, and its standing committees on legal
ethics arid the unauthorised practice of law.

At a time when improper

practices seem to be increasing space they cannot be expected to seek out
and uncover evidence of those acts, but only to consider conduct volun
tarily reported by others and to then determine whether proceeding® should
be brought to abate such practices.
Virginia State Bar, an organisation having compulsory membership, was
created in 1938 pursuant to authority granted by the General Assembly and
recited in AS J 1 - * through

of the Code of Virginia.

A reading of

those statutes makes clear the intent of the General Assembly to thereby
authorize the creation of an organization, the functions of which would in
volve solely the prevention of the unauthorized practice of law and of pro
fessional misconduct by lawyers.

The Committee considers that Virginia State

Bar, through the assessment of annual fees paid by its members. Is provided
with more than sufficient funds to supply its district and standing commit
tees with needed assistance in the form of investigators of offenses and
counsel to proceed against wrongdoers.

5. H. J. R. 50 of the 1958 General Assembly.
By this resolution the Virginia State Bar was directed to determine
whether facts found on investigations made by committee! of the Qeneral As
sembly warranted proceedings against offenders believed guilty of the unau7

�thcrized practice of law, and of unprofessional conduct.
After due deliberation of such facts, Virginia State Bar retained A. R.
Bowles, Jr. of the Richmond City Bar to bring proceedings against one
Barnard M. Savage, the Brotherhood of Railroad Trainmen, the MAACP, the Con
ference, and the H M C P Legal Defense and Educational Pond {the latter being
hereinafter referred to as MFsad®}o

Such proceedings, all for injunctive

relief, were brought by Virginia State Bar against these parties in the
Chancery Court of the City of Richmond, in which Court the suits are now
pending.

Essentially, the cases involve the question of whether lay agencies

may practice law.
If it be found that lay agencies may not practice law in the manner in
which the aforesaid groups have been conducting their affairs, all those mem
bers of the bar who have been furthering the efforts of such agencies in this
field should be dealt with in a msomer which will effectively deter them, and
any ethers so inclined, from this activity?

In the event members of the bar

are found to have furthered the practice of law by lay agencies, their punish
ment should be measured on the same scale as that on which their activities
were conducted.
6.

Legal Aid Societies.

During the Special Session of the General Assembly held in 1956, legis
lation was enacted to regulate the conduct of legal aid societies.
then, there was no fixed restraint on such societies.

Until

Prevailing laxities

in the observance of restraints imposed by that legislation seem to require
its amendment.
Recommendations

The Legal Aid Society Act should be amended in ac

cordance with legislation which will be drafted by the Committee and intro
duced at the i960 Session.

7.

The Warren County and Prince Edward County School Cases.

The Committee examined mary of the "plaintiffs’ in these cases „

The

great majority testified that they neither paid nor -were asked to pay any legal
fees or expenses, and that their- understanding was that such payments were all to
he made by the NAACP.

They further testified that they had newer been consulted

concerning the commencement of any school litigation or consulted as to its con
duct after suit was commenced, and that they had newer known they were plain
tiffs in any such litigation until that information reached them from outside
sources.
At this juncture we point out that, while technically there are two corpor
ations— NAACP and the Fund— and one association— the Conference, they operate as
one with common objectives and practices, performing in obedience to directions
received from national headquarters in New York City.
8.

The Floyd County School Case.

The Committee conducted an investigation into how the Floyd County School
case was begun.

It was found that the same pattern of NAACP activity was pre

sent! i.e. all counsel fees are payable by it and not by those referred to as
"plaintiffs", the litigation is fully controlled by the NAACP, and certain of the
apparent plaintiffs have no desire to be parties to litigation and never intended
to retain counsel of record as their lawyer.
Recommendations

The Virginia State Bar should rule on whether counsel of

record in these school cases are guilty of unprofessional conduct.
9.

Code 88 $7-l*C through 57-1*7.

The State Corporation Commission is making an investigation to determine if
the National Association for the Advancement of Colored People, the Fund and the
Conference have complied with

57-1*0 through $7-1*7 of the Code.

These sections

require certain corporations and others soliciting contributions to keep records
of such contributions.

The Code further requires that such records be made avail

able for inspection by the State Corporation Commission.

§ 58- 8 *.1, prohibiting deductions from income of contributions to persons

supporting litigation to which they are not parties.

The State's revenue

will be affected by the outcome of the proceeding before the State Corpor
ation Commission.
10.

Certain 1956 Special Session Statutes

The 1956 Special Session enacted certain statutes on barratry, cham
perty, solicitation, running and capping, maintenance and related offenses.
These laws were challenged by the NAACP and its affiliates in Xitigation
commenced in a Federal court.

Thereafter, the proceedings were appealed

to the Supreme Court of the United States, which found that the issues in
volved should be considered b y the courts of Virginia.

Thereupon, in 1958

these groups brought an action in the Circuit Court of the City of Richmond
in an attempt to have these laws declared invalid.

Evidence given in that

case disclosed that the plaintiffs at their own expense represented per
sons who were readily able to pay for themselves, and that such plaintiffs
appeared to be engaged in the unauthorized practice of law.

The Circuit

court of the City of Richmond held the laws valid, and the case is now pend
ing on appeal in the Supreme Court of Appeals of Virginia.

Farther Proceedings Against Committee.

Shortly after the entry

f the order referred to in Section 1 of this

report, the Committee had subpoenas issued out of the Circuit Court of the
City of Richmond against the NAACP, Fund and Conference.

These subpoenas

were countered b y a suit brought by these parties in the law and Equity
Court of the City or Richmond in which they sought to enjoin the Committee
from investigating them, and sought also to compel the production of the Com
mittee's records.

The complaint, although obscure in its phrasing, was

obviously intended to serve as a means of delaying the Committee in its in-

�vestigations.

And although the complaint alleged that the Committee wished

to obtain information identifying the plaintiffs' members, yet the sub
poenas in question did not seek such disclosure.

It might be here mentioned

that Oliver W. Hill, chairman of the Legal Staff of the Conference, has stated
publicly that he believes that members should make their identity know.
The Committee had the suit removed to the Circuit Court of the City
or Richmond where the subpoenas were outstanding.

That Court sustained the

Committee's motion that the complaint be dismissed, finding that it failed
to state a cause of action justifying injunctive relief.

This case is now

pending on appeal in the Supreme Court of Appeals of Virginia.

The Com

mittee must bring this case to an effective conclusion.
12.

Proceedings in Hustings Court of the City of Richmond.

In order to determine whether the tax laws of Virginia are being observed,
and especially § S 8- 8I .I, the Committee learned from State Tax authorities

that, due to the magnitude of the task, information as to contributions made
to groups supporting litigation to which they are not parties could only be
obtained from the groups themselves.

Thereupon the Committee had interroga

tories issued out of the Hustings Court of the City of Richmond and directed
to the HAACP, Fund and Conference for data as to contributions sought and re
ceived by them.

These groups moved to quash the interrogatories, and such mo

tion to quash remains undecided because of the pendency of the appeal referred
to in Section 11 of this report.

The work of the Committee should be con

tinued to obtain the requested information.
CONCLUSION
The Committee has many matters which require extended investigation,
some of such matters having been referred to in this report.

The litigation

we have mentioned and the Special Session of 1959 have prevented following

�such investigation to a conclusion.

The work of the Committee needs to be

pursued vigorously if pertinent statutes are to be enacted or revised and
kept abreast of changing conditions so as to prevent the continuance of abuses.
We consider it essential that this Committee further investigate, not
only the NAACP, Fund and Conference, but also all other persons and groups
whose activities constitute the unauthorized practice of law and breaches of
professional ethics, and those who fail to observe the tax laws of the Common
wealth.

Most State laws in this connection are
subject to various exceptions or qual
ifications.
During recent years, California,
Nebraska, and New York have en
acted legislation requiring local dis
tricts to admit to the first grade of
elementary school any child in the
locality who has successfully com
pleted 1 year of approved kinder
garten education.
FINANCIAL SUPPORT

State legislatures have provided
various methods of financing nursery
schools and kindergartens.
The method most frequently used
is local financing through the gen
eral school fund. Seventeen States
provide for funds in this manner.
Included are Maryland and South Da
kota, which finance both nursery
school and kindergarten, and Michi
gan, which provides funds only for
nursery schools through this source.
Other States that finance kindergar
ten with local funds through the gen
eral school fund are Alabama, Illinois,

Four States finance with local funds
but maintain the revenue as a special
school fund. Included in this group
are Idaho, North Carolina, and
Texas, in which such a fund-raising
device applies to their kindergarten
programs, while in Mississippi it ap
plies to both nursery and kindergar
ten schools.
Another method of local financing
is through a combination of local
school funds and fees from parents.
Wisconsin makes use of this method
for nursery schools, while Kentucky
and Virginia use it for the kinder
garten program. In addition, Okla
homa and Tennessee apply this
method to both nursery school and
kindergarten programs.
The next most widely acclaimed
method of financial support is a com
bination in various proportions of
local funds and/or State aid. This
may also include private funds.
Twelve States make use of this com
bination. One group includes Flor
ida, New Jersey, and New York, w-hich
provide funds for both nursery schools
and kindergartens, and another
group includes Massachusetts and
Washington, which provide funds for
nursery schools only. Seven addi
tional States providing funds for
kindergarten in this manner are Ari
zona, Iowa, Louisiana, Ohio, Oregon,
Rhode Island, and Wyoming.

State aid is the means of support
in nine States in the same manner as
other State aid is distributed. In
this manner, Indiana provides for
both nursery schools and kindergar
tens. Other States which finance
kindergartens in a similar manner are
California, Colorado, Connecticut,
Delaware, Michigan, Pennsylvania,
Vermont, and West Virginia. Minne
sota and Nevada apply a per pupil
formula for determining State aid for
kindergarten support.
Illinois and Oregon provide funds
for nursery schools by privately fi
nanced fees and contributions.
TEACHER CERTIFIC ATIO N

In general, States have enacted
legislation providing for higher aca
demic standards for certification.
Thirteen States now make a college
degree prerequisite to any perma
nent type of certificate. These are
California, Connecticut, Florida,
Idaho, Louisiana, Maryland, Minne
sota, New Hampshire, New' Jersey,
New York, Vermont, Virginia, and
Washington.
A more significant trend, how'ever.
points toward a greater degree of
specialization, embracing a combina
tion of subjects applicable to nursery
school, kindergarten, and early ele
mentary grades.
Thirteen States issue a special cer
tificate for kindergarten. They are

matter. They are Florida, Maryland,
Mississippi, and Ohio.
Eight States certify teachers to
teach a combination of subject mat
ter including nursery school, kinder
garten, and early primary grade sub
jects. They are Arizona, California,
Indiana, Louisiana, Minnesota, New
York, Oklahoma, and Wisconsin.
Seven States issue a general cer
tificate w'ith specialization in early
primary education. They are New
Hampshire, New' Jersey, New York,
Ohio, Vermont, Virginia, and
Wyoming.
Thirteen .States require only a gen
eral elementary certificate for teach
ing in nursery school and kinder
garten.
STATE DEPARTMENT LEADERSHIP

Recent legislative actions enable
State departments of education to as
sume a greater amount of leadership
in providing curriculum guides, es
tablishing more uniform standards,
and authorizing general supervision
to localities. Thirty-two States now
have statutory provisions that enable
their State departments of education
to assume this more responsible role.
In consulting the accompanying

of education, the reader may find in
the column on teacher certification in
formation which has implications for
State department leadership.
